Terms of Service

These Terms of Service ("Terms") are an agreement between you and Osprey Project LLC, a California limited liability company ("Osprey Project LLC", "we", "us", or "our"). They govern your use of the Osprey website at osprey.ac, including the website safety checker page at osprey.ac/check, the hosted Osprey proxy service at api.osprey.ac, and related hosted materials or services made available by us that are not expressly governed by a separate open-source license (collectively, the "Service").

By using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

1. About Osprey

Osprey is an open-source browser protection project intended to help identify potentially malicious, phishing, scam-related, or otherwise unsafe websites. It supplements your own judgment and other security tools and does not replace them.

2. The website safety checker

The website safety checker page at osprey.ac/check lets you submit a link to be scanned. Submitted links are processed as described in our Privacy Policy, which includes storing the aggregate result and publishing a public warning page for the link's registrable domain when the report is corroborated by one authoritative vendor or by two or more vendors. Published pages reflect third-party vendor reports at the time of the most recent scan and are not a statement by Osprey Project LLC that a domain or its owner has engaged in wrongdoing. If you operate a domain with a published warning page and believe the reports are mistaken, contact us (Section 19) and we will review the record. Removal from the Service does not guarantee prompt removal from third-party search results.

3. Contact form

The contact form on this website lets you send us inquiries. By submitting a message, you agree to our Privacy Policy and these Terms. If you provide a phone number and consent to SMS, we may text you only in limited support circumstances or for other non-marketing communication, as described in the Privacy Policy. Reply STOP to opt out and HELP for assistance. Message and data rates may apply.

4. Open-source software

The Osprey browser extension, OspreyProxy, and related source code made available by us are licensed under the GNU General Public License, version 3, or (at your option) any later version ("GPLv3 or later"), unless a different license is expressly stated for a specific component or file.

Your rights in that source code are governed by the applicable open-source license, not by these Terms, and that license controls in the event of any conflict. Osprey Project LLC retains the copyright it holds in that code. Materials hosted on GitHub are also subject to GitHub's own terms.

5. Non-commercial use

Osprey, the hosted proxy service, and any public APIs are made available on a non-commercial basis for end users, researchers, and organizations using them for their own internal purposes. See Section 7 for restrictions on commercial use.

Managed service providers and their clients, and organizations managing their own deployments, who access the Service through the Osprey management console under a separate agreement with Osprey Project LLC are authorized to use the Service in the course of that managed deployment. This authorization does not extend beyond the scope of that agreement or override the restrictions in Section 9.

Deploying, configuring, or managing the Service on behalf of third parties for compensation requires the management console agreement or prior written permission from Osprey Project LLC, whether or not the console is used. We may require organizations deploying the Service at large scale to enter a separate agreement as a condition of continued access.

6. No guarantee of detection

Osprey is a security aid only. We do not guarantee that the Service will detect, block, or correctly classify every unsafe site or URL. Threat intelligence can be incomplete, delayed, unavailable, or inaccurate. You are responsible for your own security decisions and for how you use the results.

7. Acceptable use

Please do not use the Service to:

• violate applicable law;
• interfere with or disrupt the Service or its infrastructure;
• bypass or circumvent security controls, rate limits, or the provider availability restrictions described in Section 9;
• send abusive, excessive, or malformed automated traffic;
• submit links to the URL check page in an automated, bulk, or abusive manner, or to harass, defame, or harm others;
• use the hosted Service or its APIs to operate, resell, or support a commercial product or service without prior written permission;
• use the Service to support harmful, fraudulent, or abusive activity; or
• extract, aggregate, compile, republish, or redistribute detection results, threat verdicts, or other output derived from the third-party threat intelligence sources described in Section 9, whether manually or through automated means, without prior written permission from Osprey Project LLC.

We may rate-limit, restrict, or block access to the hosted Service if necessary to protect the Service, users, or third parties.

8. Third-party services

The Service relies on third-party threat intelligence, DNS filtering, hosting, security, and infrastructure providers, including Cloudflare Turnstile on the website safety checker page. We are not responsible for outages, errors, policy changes, or inaccuracies caused by third-party services.

9. Third-party threat intelligence data

The Service checks URLs against threat intelligence providers, DNS filtering services, and curated threat feeds operated by third parties ("Threat Intelligence Sources"). The detection results, threat verdicts, provider identities, and other output you receive through the Service remain the intellectual property of their respective providers and are made available to you solely for your own security purposes, or for the security purposes of clients you manage through the Osprey management console, through the Service.

You may not extract, aggregate, compile, scrape, republish, redistribute, sell, sublicense, or make available to any third party the detection data or output derived from any Threat Intelligence Source, whether in whole or in part, whether manually or through automated means, without prior written permission from Osprey Project LLC. This includes building or contributing to blocklists, threat feeds, datasets, reports, or publications based on data obtained through the Service.

This restriction applies regardless of the format or medium and regardless of whether the data is combined with data from other sources. It does not prevent you from acting on detection results for your own protection or for the protection of clients you manage through the Osprey management console, from sharing a specific result with your own security team in the ordinary course of responding to a threat, or from including detection summaries in reports prepared for a managed client as part of that managed relationship, provided that such reports are not published or made available beyond the intended recipient.

Some Threat Intelligence Sources are licensed for non-commercial use only and are disabled for commercial deployments through the configuration the Service delivers. You may not circumvent these restrictions while using the hosted Service, including by altering or blocking the managed configuration, operating modified client software against the hosted Service, or concealing use of a restricted Source through suppressed or falsified telemetry. Circumvention is grounds for immediate termination of access and of any management console agreement. This paragraph conditions access to the hosted Service and does not limit rights under the software's open-source license.

10. Privacy

Our Privacy Policy describes how Osprey processes data.

11. Project name and branding

The Osprey name, logos, branding, and other non-code materials are owned by Osprey Project LLC. These Terms do not permit their use in a way likely to cause confusion about affiliation, sponsorship, or endorsement.

12. Termination

We may suspend or terminate your access to the hosted Service at any time for violation of these Terms, to protect the Service, users, or third parties, or where required by law or by a Threat Intelligence Source's licensing. Sections 9 and 14 through 18 survive termination.

13. Changes

We may modify, limit, suspend, or discontinue any part of the Service at any time, and may update these Terms. The effective date above reflects the most recent revision. Continued use after an update means you accept the revised Terms.

14. Disclaimer

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTY THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, ACCURATE, OR EFFECTIVE AT DETECTING OR PREVENTING ANY PARTICULAR THREAT.

15. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OSPREY PROJECT LLC AND ITS MEMBERS, MANAGERS, CONTRIBUTORS, MAINTAINERS, OPERATORS, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE SERVICE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE TOTAL AGGREGATE LIABILITY OF OSPREY PROJECT LLC ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100 USD).

16. Indemnification

You agree to defend, indemnify, and hold harmless Osprey Project LLC and its members, managers, contributors, maintainers, operators, licensors, and service providers from any claim, liability, damage, loss, or expense, including reasonable attorneys' fees, arising out of your use or misuse of the Service, your violation of these Terms, or your violation of any law or third-party right.

17. Governing law

These Terms are governed by the laws of the State of California, without regard to its conflict of laws rules, except to the extent applicable law requires otherwise.

You and Osprey Project LLC agree that the state and federal courts located in San Diego County, California have exclusive jurisdiction over any dispute arising out of or related to these Terms or the Service, except to the extent applicable law requires otherwise.

18. General

If any provision of these Terms is found unenforceable, it will be limited or eliminated to the minimum extent necessary and the remaining provisions will remain in full force. These Terms and any separate agreement referenced in them are the entire agreement between you and Osprey Project LLC regarding the Service. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms without our prior written consent; we may assign them in connection with a reorganization or transfer of the Service. You must be at least 13 years old to use the Service.
