Terms of Service
These Terms of Service ("Terms") are an agreement between you and Osprey Project LLC, a California limited liability company ("Osprey Project LLC", "we", "us", or "our"). They govern your use of the Osprey website at osprey.ac, including the website safety checker page at osprey.ac/check, the hosted Osprey proxy service at api.osprey.ac, and related hosted materials or services made available by us that are not expressly governed by a separate open-source license (collectively, the "Service").
By using the Service, you agree to these Terms. If you do not agree, please do not use the Service.
1. About Osprey
Osprey is an open-source browser protection project operated by Osprey Project LLC. It is intended to help identify potentially malicious, phishing, scam-related, or otherwise unsafe websites.
Osprey is meant to supplement your own judgment and other security tools, not replace them.
The Osprey website also provides a website safety checker page at osprey.ac/check, where you may submit an individual link to have it scanned against the same providers used by the extension. Links you submit on the website safety checker page are sent to the hosted proxy service and processed as described in our Privacy Policy, which includes durably storing the aggregate result for a submitted link and publishing a public warning page when several vendors independently report the link as phishing or malicious. Results are provided for your information only and are subject to Section 5 (No guarantee of detection).
2. Open-source software
The Osprey browser extension, OspreyProxy, and related source code made available by us are licensed under the GNU General Public License, version 3, or (at your option) any later version ("GPLv3 or later"), unless a different license is expressly stated for a specific component or file.
Your rights to use, copy, modify, and distribute project source code are governed by the applicable open-source license, not by these Terms. Osprey Project LLC retains ownership of the copyright it holds in that code.
If there is any conflict between these Terms and an applicable open-source license with respect to software released under that license, the open-source license will control for that software.
3. GitHub
Project source code, releases, issue tracking, and related materials may be hosted or distributed through GitHub. Your use of GitHub is governed by GitHub's own terms, policies, and privacy practices, not by these Terms.
4. Non-commercial use
Osprey is made available on a non-commercial basis for end users, researchers, and organizations using it for their own internal purposes. The hosted Osprey proxy service and any public APIs made available through it are likewise provided on a non-commercial basis.
Restrictions on commercial use of the hosted Service are described in Section 6 (Acceptable Use).
5. No guarantee of detection
Osprey is a security aid only. We do not guarantee that the Service will detect, block, or correctly classify every malicious, phishing, scam-related, deceptive, or otherwise unsafe site or URL.
Threat intelligence can be incomplete, delayed, unavailable, or inaccurate. You are responsible for your own security decisions and for how you use the results provided by Osprey.
6. Acceptable use
Please do not use the Service to:
- violate applicable law;
- interfere with or disrupt the Service or its infrastructure;
- bypass security controls or rate limits;
- send abusive, excessive, or malformed automated traffic;
- submit links to the URL check page in an automated, bulk, or abusive manner, or to harass, defame, or harm others;
- use the hosted Service or its APIs to operate, resell, or support a commercial product or service without prior written permission; or
- use the Service to support harmful, fraudulent, or abusive activity.
We may rate-limit, restrict, or block access to the hosted Service if necessary to protect the Service, users, or third parties.
7. Third-party services
The Service may rely on third-party threat intelligence, DNS filtering, hosting, network, security, monitoring, or infrastructure providers. We are not responsible for outages, errors, policy changes, or inaccuracies caused by third-party services.
The website safety checker page is protected by Cloudflare Turnstile to prevent automated abuse. How Cloudflare processes information for this purpose is described in our Privacy Policy.
8. Privacy
Our Privacy Policy describes how Osprey processes data, including limited operational monitoring and service telemetry used to run, secure, and maintain the service.
9. Project name and branding
Except to the extent governed by applicable open-source licenses, the Osprey name, logos, branding, website content, and other non-code materials are owned by Osprey Project LLC and may be protected by applicable law.
These Terms do not give you permission to use the Osprey name, logos, branding, or other source identifiers in a way that is likely to cause confusion about affiliation, sponsorship, or endorsement.
10. Changes to the Service
The Service may change over time, and we may modify, limit, suspend, or discontinue parts of it at any time.
We may also update these Terms from time to time. The effective date above reflects the date of the most recent revision. Continued use of the Service after an update means you accept the revised Terms.
11. Disclaimer
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTY THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, ACCURATE, OR EFFECTIVE AT DETECTING OR PREVENTING ANY PARTICULAR THREAT.
12. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OSPREY PROJECT LLC AND ITS MEMBERS, MANAGERS, CONTRIBUTORS, MAINTAINERS, OPERATORS, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE SERVICE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE TOTAL AGGREGATE LIABILITY OF OSPREY PROJECT LLC ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100 USD).
13. Governing law
These Terms are governed by the laws of the State of California, without regard to its conflict of laws rules, except to the extent applicable law requires otherwise.
You and Osprey Project LLC agree that the state and federal courts located in San Diego County, California have exclusive jurisdiction over any dispute arising out of or related to these Terms or the Service, except to the extent applicable law requires otherwise.
